1/ The definition of "Sale" includes "consulting/ support services related to the Software". Can Copyright really forbid people to use their knowledge? Could this potentially mean your staff is no longer allowed to maintain your own systems running this solution?

2/ "a product or service whose value derives, entirely or substantially, from the functionality of the Software." What is "substantially"? Where is that line drawn? The only way to be safe seems to be if the software is basically useless to you. But then why use it?

3/ Why would anyone want to contribute to a project under such a license? Your contribution may already be a violation under (1) if you were doing this as part of a professional gig.

5/ Calling this Apache licensed with an additional clause seems to be purposefully misleading people to believe software under such a license could be Open Source when this is really a new, proprietary license. Why abuse

Overall it seems purposefully vague & misleading, probably overreaching and terribly one-sided to establish Fear, Uncertainty and Doubt for any professional use of software licensed under it while making it terribly easy to "accidentally" incorporate such components.

TL;DR: It reminds me a whole lot of the principles behind the toxic effect of software patents. It seems a license to threaten legal action more than it seems a license that establishes clarity and arms-lengths relationships.

It seems an underhanded attempt to appropriate the commons. Calling it "Commons Clause" appears Orwellian - and given the background of
