Every jail in the country records prisoners call. Nothing new here. Next.

I've seen references to jailhouse calls biting defendants who were recorded talking to family or friends, etc. But I can't recall a real case involving a call with their lawyer. Saw a fictional L&O episode once where the lawyer was also a suspect so it was allowed as evidence.

In my previous life I’ve had to rule on the admissibility of those recordings.

So under what circumstances are a defendant's conversations with his/her lawyer admissible? What's the threshold?

No expectation of privacy for someone in jail calling out or talking on the telephone. Face to face meetings with lawyers are different.

Yes, even if. Theoretically, only time a prisoner is not monitored 24/7 is when she is physically visiting with her attorney. Can’t speak for all states. The principles are the same but I’m sure there are nuances.

Then why is there case law challenging if/when those recordings are used? Seems to me that poorer defendants who cannot afford bail are put at a much greater disadvantage re: ease of communicating with counsel vs. others. But what else is new about that $$ imbalance, right?
