The issue of what constitutes sexual consent, and whether or not the law reflects contemporary sexual encounters, was at the core of a rape case in Australiahttps://nyti.ms/2FUJdY6

The female judge who resided over this appeal should be totally ashamed of her decision. It seems that wealth, and a judge who thinks contemporary morals trumps a young virgin’s right to say stop, allows a predator to get away with rape.

The NT is a back water and incompetence on many levels played a big part in that investigation. There are still idiots out there who believe Lindy was guilty. 😩

The creep also sent a text to a friend to brag about having anal sex with a virgin. At no time did the creep consider the enjoyment or attempt to sexually arouse the young girl he raped - if a male isn’t considering the enjoyment or arousual of the female, how is this not rape?

Just because somebody is a creep doesn’t mean that they’ve raped somebody, takes a vicious and awful human being to rape another individual, simply being a creep “trying to get some” doesn’t constitute rape, and should not unless the circumstances clearly imply a lack of consent

Having all the facts available to me, I can assure you this creep behaved in a predatory fashion and has escaped justice because of legal interpretations. The girl he raped had known him for less than 1/2 an hour!

I’ve read the case facts as well and have followed this case extensively over the last 5 years, the Tasmanian consent laws should surely be implemented here in NSW, however a jail term when her consent was in question during the trial, what happened to reasonable doubt?

He got away with rape & a jury of twelve agreed. The laws have been found wanting & amendments are in the pipeline so no sexual predator ever gets away with this vile behaviour, EVER again. It’s tragic Saxon had to be a victim in order to bring forth change.

Jury agreed because judge misdirected them, hence retrial. Vile behaviour doesn't equate to prison time if consent not obvious to them (both of them we're intoxicated as well), in circumstances. I feel sorry for her and hope there is change ahead.

One thing is certain in all of this, it sheds light on the disgusting attitude some males have towards women & provides a cautionary tale to other women to steer clear of this poor excuse for a man. Gentleman he is not! And holding a celebratory party? All class...NOT!

Best advice from the article: “Enthusiastic consent is really easy to determine. I think if you don’t have that, then you’re not good to go. “All you need to say is, ‘Do you want to be here?’ And, very clearly, ‘Do you want to have sex with me?’”
