        but it is BETRAYING its LEGAL DUTY to PROVIDE NECESSARY FUNDING for the U.S. STATES. This is without historical precedent. As for the emissions battle, name one instance where Federal Preemption is NECESSARY & PROPER to LOWER Health & Safety standards, i.e., vs. INCREASING them
