        This'll get obliterated at the Supreme Court. Love or hate the CFPB, you can't have a nominally executive office whose leadership aren't fully answerable to the executive.

        In fact, we can and do have such offices. That's exactly what independent agencies are – agencies that are independent of presidential control to some degree. There are a number of them aside from CFPB.

        I assume you're talking about agencies that include Senate confirmed positions. But the CFPB isn't that. On its face, the law says that whoever is No. 2 becomes No. 1 when No. 1 leaves. Essentially, it lets No. 1 pick his/her successor. That's crazy.

        Correct me if I'm wrong, but doesn't the CFPB only authorize the Deputy Director (English) to become *Acting* Director temporarily during a vacancy until someone is nominated and confirmed by the Senate to become the Director?

        So, my reading of it is that it doesn't let "No. 1" pick his/her permanent successor, only the person to temporarily fill the role should it become vacant. Trump is free to nominate Mulvaney to be made Director thru the normal advice/consent process.

        It doesn't say that explicitly, but functionally that's what happens. And that's literally the argument that Elizabeth Warren, who founded the agency, has made. I actually like what the CFPB is doing, I just don't see how this structure makes sense constitutionally.
