        This sounds like an ugly mess. In one hand he might be a traitor, and we may not have enough evidence that he is. In the other hand, he might not be a traitor, and our government might be trying to avoid larger legal issues regarding the right to have war in Iraq. Wow, difficult.

        Maybe, it's still complicated, if he is in a foreign nation fighting with a declared Enemy of the State, that would be treason and up to the military courts, not civilian courts. Tricky thing sometimes, the way the Constitution works. I agree though, let the attorneys decide.
