Confusion reigned at a federal consumer agency as two bosses showed up, one an Obama holdover, the other a Trump pickhttp://nyti.ms/2zHXoSe

Trump has no power of appointment here, so his pick is lip service and nothing more. Just like most of the things he says. Fight me.

Art 2 Sec 1. This particular provision of the law--that congress declares the succession of an executive agency, violates separation of powers.

The Dodd-Frank law requires the president to submit his nomination for director of the CFPB to the Senate for confirmation.

That's also iffy from a constitutional standpoint, but the interim succession provision that is at issue here is clearly unconstitutional.

The Dodd-Frank law is clear about the appointment of a new director, she/he must be approved by a senate vote. In the interim, the law is clear that the dep dir becomes the acting dir. The law is clear.

        Replying to @CharlieSweeney @timmaguire42 and

If you're saying Dodd-Frank's language on succession is unconstitutional, then you're making a separate, unrelated argument that would have to be litigated separately.

Mulvaney is taking over. End of story. The CFPB is run by far left Dems from top to bottom. They actually believe they know whats best for the consumer. The consumer knows whats best for the consumer. This egregious overreach by govt is coming to an end

You think Mulvaney knows what’s best for the consumer? Only if you’re worth a few million bucks, Larry. Why is every Dem labeled as far left? Are all Republicans far right?
