        I think the 10th Amendment will do more to save net neutrality than the federal court system. Whether Mr. Pai is a John Marshall purist, or a small government republican remains to be seen.

        The courts are the last defense of liberty in our system. Which is why the Senate is burning tradition and norms to fill all the vacancies they denied Obama. Nominees deemed unqualified by ABA are good to go if they pass the ideology tests.
