Airlines are free to offer less and passengers are free to accept less if they like, but they're also free to decline and keep their seat.

Obviously, there's a big difference between a $800 voucher with all sorts of fun caveats and $1,350 cash, so "no other choice" is nonsense.

Presumably if one 'voluntarily' 'waive' ones rights then the law doesn't carry much force?

Courts tend to take a dim view of contracts that include language like that, especially in cases like this.
