        They lost because publishing a sex tape was a violation of hulk's privacy and wasn't in the public interest. Not libel though.

        To some extent, I agree. A trashy, unethical org. like Gawker is vulnerable to this sort of attack in a way NY times is not.

        Agreed. Still, this is worrisome b/c even frivolous lawsuits are expensive. Gives the rich a way to block unfavorable news.
