          DeVos was sued by several women’s rights groups in Massachusetts federal court last October. The groups asked the court to vacate the DeVos Rules & require all schools to treat sex-based harms the same as harms based on race & ntl. origin bc that’s what Title IX mandates!

          These proposed rules mirror subregulatory guidance document DeVos issued last September. Both are illegal bc DeVos has no authority to weaken Title IX. These new rules DO weaken Title IX by subjecting sex-based civil rights harms to worse treatment than harms based on race, etc.

          This is nothing new for private institutions. I’ve witnessed this happening in private high schools and baording schools - the administration keeps matter quiet and handles misconduct internally,as they see fit- and that’s the problem. Authorities notified only in certain cases.

          2d lawsuit vs. DeVos was filed months after MA suit, in CA, but plaintiffs did NOT ask for equal treatment of women. They complained about minor aspects of the DeVos Rules, & asked court for only 2d class treatment. If successful, they will weaken Title IX & make bad law 4 women.

          DOE has NO authority to regulate viol. against women; & very little authority to regulate civil rts under Spending Clause. DeVos issued rules under SaVE Act, not Title IX. DOE cannot weaken Title IX by requiring schools to comply with non-civil rts laws when enforcing #TitleIX

          Proper authorities are the only ones who should be handling these cases. Sexual assault is a crime and the police deal with crimes. Colleges handling never made much sense to begin with.

          If colleges are willing to change victims housing and schedules and counsel them instead of contacting authorities, chances are they know something happened and are letting a guilty man walk around their campuses with no punitive action to protect the college's reputation.

          But some victims can't AFFORD to go forward formally without rocking the boat and creating damage to THEIR OWN reputation for whistleblowing. The former scheme provided autonomy for victims & institutions to cater a plan/accommodations so a victim can still attend school

          We can't change how society thinks, but we can change how colleges handle accusations. While it is important for the victim to attend school, it is also important that colleges protect other students from the accused.

          It is called due process. An accusation is not guilt. If you want to press charges, then do so. If not, then it is over and done with period.

          But that is precisely why Title XI of the Civil Rights Act exists separate and apart from the conventional processes. It's an enhancement in the law to help alleviate problems that the conventional process was not solving.

          Again this isn't my opinion, this is the scheme as enumerated in Title IX of the Civil Rights Act. Administratively it will be carried out differently but this is how it was being done before.

          It was the dear colleagues letter from the Obama admin. Basically no due process and star chambers courts out of Kafka where the accused is not allowed a lawyer or to present evidence. I think it was today a girl went to jail for lying about a rape by two football players.
