Question: When you accept money in exchange for your silence or NDA, if that silence/NDA is broken...do you have to pay it back? (If not, you should)

Of course... That's kind of the whole point of an NDA and buying someone's silence, otherwise people would take the money and spill secrets. In fact some NDAs not only require you to pay that money back, but pay a penalty as well.

As it should be! I have to sign them all the time, you cant just go around breaking them. Thats breach of contract and you can be (and should be) sued.

Well that's the person's personal choice. They're adults. They're aware of the consequences. Sometimes the consequences are worth breaking the contract.

Sure, they can break it but they should be held accountable for breaking a contract and if money was involved should have to pay every dime + interest back and be sued.

I disagree entirely. It can be a sexual transaction and also abuse. If she felt obligated to service him to save her own career, that is a transaction but is also abuse of power.
