If you press decline you can't proceed , the only way to proceed is to uncheck and accept. Note : use Apple build in Authentication, you will find it in Passwords , move All your Accounts to that.

Exactly, the buttons are for the ToS / Privacy Policy, the toggle is for the diagnostic data, this is a PEBKAC issue.
