The icon having just one generic state wouldn’t prevent you in any way from doing any of the above, though…?
In the sense that my desktop doesn't have the icon because I don't use it, indeed it wouldn't change my usage pattern. On the phone though, I am more likely to use the photo app's bin, whatever the icon (because there's always stuff in there). So, +1 in this case.
