      Having now carefully read the entire Obstruction volume of the Mueller Report, I do think there's a strong possibility that Trump will be indicted on some obstruction charge upon leaving office, most likely by the SDNY. I'm not making a value judgment about this, just observing

      Again, I'm not making any normative claim about the utility of such a prosecution. I'm just saying that the fact-pattern laid out by Mueller, as well as the various legal arguments he cites involving obstruction, make reasonably likely that such a prosecution will occur

      In the case of SDNY, an obstruction charge is probably on stronger footing because there *was* found to be underlying criminality, in the form of the campaign finance violations Cohen pleaded guilty to. So if Trump "obstructed" that investigation, different factors are operative

      At the same time, the supreme irony of the only "underlying criminality" found by the Mueller investigation being payoffs to a porn star should not be lost on anyone. (And obviously this would all be thoroughly litigated. Not even clear Cohen's conviction would hold up on appeal)

          Trump would skate easily. The feds win so much because they basically threaten bankruptcy on whoever they go after. Trump will have plenty of money to fund the best defense team and wilt the SDNY away

          Cohen pled guilty. There's no appeal. That said, there are serious ??? about whether what he pled guilty to is even a crime. He was let off easy on most of his offenses & not charged w/some to get him to plead to something that was tied to Trump. THAT is how corrupt the DOJ is.

          That’s utterly ridiculous. Under US campaigns finance law, hush money payments to mistresses can’t be a lawful campaign expense. Cohen pled guilty to something that can’t be a crime.

          @AlanDersh pointed out that Cohen pleaded to a non-crime, as NDAs are not illegal. Also, it wasn’t “found” in the sense of a judicial ruling; it was a prosecutor’s plea deal.

          Glad you added the parenthetical here. It is not clear it would hold up. There is a second issue, Cohen could be guilty of an FEC violation while Trump would not. Third, Trump's attorney did not prevent the SDNY from obtaining records - Cohen's tapes being an example.

          The idea of a President being charged with criminal conduct after he/she leaves office by a state or district court, for conduct that occurred while in office, is incredibly destructive to our form of government!
