    Having now carefully read the entire Obstruction volume of the Mueller Report, I do think there's a strong possibility that Trump will be indicted on some obstruction charge upon leaving office, most likely by the SDNY. I'm not making a value judgment about this, just observing

        Again, I'm not making any normative claim about the utility of such a prosecution. I'm just saying that the fact-pattern laid out by Mueller, as well as the various legal arguments he cites involving obstruction, make reasonably likely that such a prosecution will occur

        In the case of SDNY, an obstruction charge is probably on stronger footing because there *was* found to be underlying criminality, in the form of the campaign finance violations Cohen pleaded guilty to. So if Trump "obstructed" that investigation, different factors are operative

        At the same time, the supreme irony of the only "underlying criminality" found by the Mueller investigation being payoffs to a porn star should not be lost on anyone. (And obviously this would all be thoroughly litigated. Not even clear Cohen's conviction would hold up on appeal)

        There is a compelling legal argument for it. Mueller was cautious, but that doesn’t (and in my mind shouldn’t) bar Congress from acting given the ambiguity of Trump’s actions.

        Mueller's "caution" (which is not how I'd characterize Mueller's approach) shouldn't bar Congress from acting; Congress should refrain from acting for other reasons.

        Highly unlikely. The definition they used was likely come up with by Weissman.... who was reversed doing something similar 9-0 by the Supreme Court

        Bingo . You can always find prosecutors to stretch and interpret the law to prosecute . Mr Weissman record on this matter is not good as you point out . precedent makes it unlikely his interpretation of the law will be respected .

        And then there is this. 'Michael Cohen denied in a secretly recorded phone call with actor Tom Arnold that he committed some of the crimes to which he has pleaded guilty.' If he told this to trump & trump didnt tell him to lie, how was trump 2 know there was anything to obstruct?

        He might be indicted but there's no way he'll be convicted. The legal theory surrounding obstruction of crime when a President was a) only using his constitutional powers and b) the investigation was not ultimately hampered is murky at best.
