I can't get over how idiotic this talking point is: "The 25th Amendment is in the Constitution, so any scheme hatched by a bureaucratic cabal to depose the president must be legal if the schemers invoke it." Never underestimate how much bad punditry is driven by sheer stupidity

      Michael Tracey Retweeted Alan Dershowitz

I'm not a fan of Dershowitz, but I don't see any plausible counterargument here. Either way, invoking the 25th Amendment would obviously not be the purview of the FBIhttps://twitter.com/AlanDersh/status/1096433289311731712 …

It is unconstitutional to use the 25th Amendment to circumvent impeachment provisions. The 25th can be used only if POTUS is physically or psychiatrically incapacitated. Any other use is unconstitutional. I challenge anyone to argue differently.

The FBI doesn't have a charter so there are no boundaries to their purview. They compel resignations of public officials quite frequently. Mark Felt aka Deep Throat in Watergate was the #2 for more than a quarter century. No rules so impossible to say if bad or not

True, but the purview of the 25th Amendment is circumscribed by the text of the amendment, and McCabe/Rosenstein did not occupy any of the relevant positions enumerated by the amendment.

People should try actually reading the 25th amendment. As long as Trump is capable of writing a letter, it takes a 2/3rds vote in both the house and senate to remove him. The only way this would work is if they kept him locked up or somethingpic.twitter.com/5p2NioerM6

I'm with Dersh. The 25th Am is not intended to be a weapon for unelected bureaucrats to remove a president because they despise him.

They were being emotional but neither could they nor did they (apparently) actually get down to trying to invoke it. They were just being sore losers wondering aloud if they could throw the chessboard into the air.

No one ever said the 25th amendment was the purview of the FBI. They discussed trying to convince cabinet members to invoke it. Which is the proper body (plus VP) with the purview. Why is this so hard for you to get?

The argument being clearly the DOJ thought the president was Psychiatrically unfit and were trying to get cabinet members to remove him from office on that basis.

No, it's not the FBI's purview. But they may certainly discuss it with the people who do have the power to invoke it. Those officials can listen, or not, as they see fit.

If the FBI has evidence of wrongdoing by POTUS then it is ABSOLUTELY in their purview to explore options to protect the nation. That’s why the 25th amendment exists. If Congress fails and the POTUS is obstructing justice/firing the people who can investigate him.
