"...written declaration that the President is unable to discharge the powers and duties of his office..." Furthermore, there is a provision for the President to challenge this which is similar to the impeachment/conviction process.

Obviously, the latter provision is so a President who is not incapacitated will be given the same due process as in impeachment proceedings. The whole 25th gambit is a dopey idea that lazy authoritarians like McCabe were hoping would be an easy way out.

I’m pretty sure that “I don’t like Orange Man” falls short of presidential incapacity. The purpose of this type of thing is to ensure continuous functioning of the republic, not to secure cheap political victory.

It would legally apply in any situation where you could get the VP and a majority of the principal officers of the executive departments on board with declaring the president unable.
