Not a stretch to say: the FBI criminally investigating Trump on the basis of the "national security threat" he allegedly poses, with the "threat" being his perceived policy preferences re: Russia, could constitute literal criminalization of deviation from foreign policy consensus

The NYT story details the explicitly political and ideological motivations for the "counter-intelligence" investigation that commenced after Trump fired Comey:https://twitter.com/mtracey/status/1084132759382171648 …

Lisa Page acknowledges that the impetus for the "Russian asset" investigation opened after Trump fired Comey was ideological in nature: based on tired Cold War 2.0 tropes and the need to defend America's "moral authority." So basically confirms the FBI was acting politically pic.twitter.com/sOoCox01vI

Jack Goldsmith describes the implications of this in much greater detail. https://www.lawfareblog.com/what-grounds-can-fbi-investigate-president-counterintelligence-threat …pic.twitter.com/XaaOOoNqmt

Goldsmith makes the point that determining what constitutes a "national security threat" is entirely subjective, and isn't the FBI's purview. The same logic could've been used to constrain previous presidents from making controversial decisions, and also inhibit future ones.pic.twitter.com/iCWlOvklJh

Throughout this ordeal, the ramifications of the FBI's conduct have been critically examined almost exclusively by right-wing outlets, who conflate it with all kinds of partisan wish-fulfillment and buffoonish Trump loyalism. But the implications extend well beyond Trump.

For clarification: the post-Comey investigation is described as "counter-intelligence" in nature, but there's no reason to believe that's meaningfully distinct from "criminal." If the FBI uncovers criminality, it will pursue prosecution. That's its core organizational mandate.

I'm counting four articles so far in the last 2 days by McCarthy, Mark Penn, Turley and Goldsmith attempting to mitigate the behavior of the FBI/DOJ by calling it "an overstep", the result of "political emotion and hysteria" or "confirmation bias". Spin cycle?

Same media that 'missed' the WMD Lie and Trump's likely 2016 electoral victory are now 'missing' the blatant FBI abuse of power. Our nation will be destroyed if our media does not wake up.

Fact...Comey testified before Congress and the American ppl that @POTUS was NOT under investigation. Point of article..null and void.
