Not a stretch to say: the FBI criminally investigating Trump on the basis of the "national security threat" he allegedly poses, with the "threat" being his perceived policy preferences re: Russia, could constitute literal criminalization of deviation from foreign policy consensus

The NYT story details the explicitly political and ideological motivations for the "counter-intelligence" investigation that commenced after Trump fired Comey:https://twitter.com/mtracey/status/1084132759382171648 …

Lisa Page acknowledges that the impetus for the "Russian asset" investigation opened after Trump fired Comey was ideological in nature: based on tired Cold War 2.0 tropes and the need to defend America's "moral authority." So basically confirms the FBI was acting politically pic.twitter.com/sOoCox01vI

Goldsmith makes the point that determining what constitutes a "national security threat" is entirely subjective, and isn't the FBI's purview. The same logic could've been used to constrain previous presidents from making controversial decisions, and also inhibit future ones.pic.twitter.com/iCWlOvklJh

Throughout this ordeal, the ramifications of the FBI's conduct have been critically examined almost exclusively by right-wing outlets, who conflate it with all kinds of partisan wish-fulfillment and buffoonish Trump loyalism. But the implications extend well beyond Trump.

For clarification: the post-Comey investigation is described as "counter-intelligence" in nature, but there's no reason to believe that's meaningfully distinct from "criminal." If the FBI uncovers criminality, it will pursue prosecution. That's its core organizational mandate.

Well, it's a complicated story, which requires some nuance in how you word things. Nothing was formally criminalized (that we know of) but the specter of criminalization is bad enough.

Amazing that people don't recognize this as the outrageous & dangerous McCarthyite thing it is. The FBI deciding POTUS needs to be investigated as a foreign agent, on basis of its (Lisa Page's!) notion of "Western ideals" and "what Americans stand for"!

Has Trump actually drifted from foreign policy consensus? Or is his very presidency a threat to that consensus which decides?

Trump even making sporadic calls for such deviation is enough to alarm the powers-that-be into rationalizing any outrageous overreach to try to keep it from becoming reality. This is somewhat comparable to Assange being "safe" as long as he doesn't step out of the building...

Lawfare makes that point. You could imagine McConnell in 2015 saying the Iran deal is a "treasonous abandoning of an ally" which is a political claim that could be weaponized by sympathizers in the NatSec establishment for partisan gain.https://www.lawfareblog.com/what-grounds-can-fbi-investigate-president-counterintelligence-threat …
