    No question that the 'travel ban' originated in Trump's oft-expressed irrational animus. But resting the challenge on discerning his motivations may have been a mistake. If the president was a more genteel and careful speaker, yet wanted the same policy... then what?

        Put another way: say some candidate seeks to impose a ‘travel ban’ because he’s motivated by animus, but (unlike Trump) manages to conceal the animus. Unclear what avenue could be pursued to challenge that, given the logic set forth by Sotomayor, which relies on *revealed* animus

        Sotomayor hints at ways the “rational basis” standard could be undermined absent a clear demonstration of animus, but always ties it back to Trump’s animus-revealing statements. To curtail the foundation of executive power, reasoning can’t be contingent on one person’s utterances

        And that's the exact reasoning of the majority decision by the court. This can be extrapolated to MANY other bullshit things Trump spews on corporate media or Twitter. For most of it, he cannot be held legally liable. He can say "you misinterpret my WORDS".

        To clarify, Trump or any of his stooges like Giuliani can say an infinite amount of BS on corporate media and social media, because they're just WORDS, not actions. Yet too many people take what these imbecile say at face value, as if they're legally accountable for this speech.

        You're making the same mistake the minority did in today's decision: you assume you can read the president's mind. You're not allowing for the possibility that once he won, someone convinced him that a Muslim ban was a bad idea. To not allow for this possibility is folly.
