This is shocking but not surprising. It certainly won’t help the reputation of the Supreme Court. The Court needs a code of ethics, the federal judiciary needs an inspector general, and the courts need to show that they are willing to hold judges accountable for misconduct.

A very convincing demolition of every facet of Judge Cannon’s decision. DOJ has now thrown her a life preserver in asking for a partial stay. We’ll see if she’s smart enough to use it.
100%, and if necessary a hearing to determine what evidence was generated by the privileged documents, which could also be suppressed. Unless we are carving out an exception in the criminal justice system for former presidents who steal government documents.
If DOJ has already reviewed the MAL documents, isn’t the special master’s work moot? Wouldn’t privilege questions best be handled in pretrial motions after indictment? Remedy would be suppression from evidence at trial.

This order is designed to stop the criminal investigation in its tracks. Not clear DOJ can even safely follow up on investigative steps it would have taken before the MAL search. It would have to prove those steps were planned before the search. Judge has created a mess.

Nothing--not even the unwritten rule-- should stop DOJ from following up on the scores of investigative leads generated by the Mar-A-Lago search, including interviews of the people seen moving the docs. That's not "overt" unless Trump or his employees choose to make it so.

Oversight over ongoing criminal investigations simply doesn't happen, unless you want to kill the investigation. This is dishonest and disingenuous grandstanding for an audience of one.

Ten years later, I supervised a team that worked in a SCIF at DOJ. All the materials they worked with never left the facility. The lead investigator lived in NY and had to come to DC to work with the documents.
