        That does not sound like a punt. Sounds like explanation that a position was taken in the past that should not be used as prediction in future because not related to specific situation, implying new situation could warrant different response.

        Since I am not a legal scholar I have to read the opinions of those that are. I have read those who have opinions on both sides of this issue. Certainly, there is no precedent to indict a sitting POTUS. On the other hand, from what I can tell, there is also nothing prohibiting.

        That's not how CBS is reporting it. The CBS Evening News said sitting President can't be indicted like it was a current decision by the Justice Department.

        CBS doesn't determine judicial law, so I think they decided to report on what has happened to date, not to state definitive constitutional law. It's "safer" (they won't be tweeted at by an annoyed child).
