Good get, Fraser! This would make those communications a violation of that statute. In addition, any instructions to withhold evidence would show intent, which put the teeth into a charge of Obstruction of Justice.

Richard W Painter has been expressing his displeasure with WH/Bannon communications since Bannon departed, & saying it violates this statute. So, it wasn't me. Also, he must be on the Title 5 list for the statute to apply. Since he was a top advisor he should be on the list.

WH has demanded Bannon not talk about his time in WH and the transition but the Peter Smith-Flynn plot to "find HRC's deleted emails" with help from Russian hackers was during the campaign... Maybe he would give up the goods there – thought he may just blame it all on Flynn...

Whitehouse is risking an obstruction charge so you would expect that Bannon can torch them. Mueller will move fast to put him in the grand jury and let the district court rule on the privilege assertion. This is where Trump having F- legal team will become a big deal.
