It's nonsense. "Under the fundamental rule that no one may be a judge in his own case, the President cannot pardon himself." Aug. 5, 1974 DOJ opinion, 4 days before Richard Nixon resigned. It's right there on the DOJ website: https://www.justice.gov/file/20856/download …
-
Where is that fundamental rule in the Constitution? Seems like an unwritten rule like so many Trump has broken.
-
The Constitution is not an exhaustive document. Something need not be explicitly stated in the Constitution for it to be true. That was the whole point of the 9th Amendment.
-
True, but without precedent or law making it illegal, there's nothing stopping him from pardoning himself.
-
The absence of a court decision or explicit law means that it is undecided. If a POTUS were to pardon themselves, it would quickly go to the SCOTUS which would rule on the Constitutionality of a self-pardon. So, POTUS can try a self-pardon but it might not be Constitutional.

This article has a lot of opinions from lawyers. I hope the Supreme Court would agree that the President is not above the law, but can't be certain they will do so.https://www.cnbc.com/2018/06/04/here-is-what-9-experts-say-about-whether-president-trump-can-pardon-himself.html …

Not since the GOP stole a Supreme Court seat and God knows how many judgeships. Republicans play the long con.

Funny, if I were Senate Judiciary Chairman and the President's was publicly declaring himself above the law I would immediately initiate impeachment proceedings.
-
Initiation starts in the house.
-
Yes yes, the buck stops over there. The Senate is powerless to check the President.

-
No, the Senate can do a lot. They just can't start impeachment proceedings.

Why doesn't someone, oh, I don't know, maybe a reporter who covers the Senate, perhaps, actually ASK Grassley and all other Senate Republicans ON THE RECORD whether they agree that a president can pardon himself? Would it be too much to ask reporters to do their job?
-
I phoned Congressman Michael Burgess to ask if he had any thoughts on this. “No comment”. Ted Cruz nor John Cronyn, TX Senators don’t answer.
-
Cruz’s office answered when I called. Woman said he’d probably put out a comment via Twitter later today. Said it just happened this morning. Pointed out Cruz already tweeted about cake baking. She said she’d pass on my thoughts.
-
Oh I have some more thoughts if they're going to pass them along..
-
Best plan with Cruz is to get out the vote for
@BetoORourke -
Just 5 more months until Beto represents the proud state of Texas!!!
-
Hi Molly, as a Texan do you believe he stands a chance of winning?
-
Yes! I really do! I’m in No Tx and in my neighborhood there are Beto signs everywhere! Haven’t seen one Cruz sign! Sure hope Beto wins he’s got my vote!
