      You can say interstate sovereign immunity is "integral to the structure of the Constitution" and "implicitly" required by it—but that sounds an awful lot like making it up. At a minimum, it's no different from saying the right to abortion is "implicit in the meaning of liberty"pic.twitter.com/hzLBZX4yt1

      I'd respect Gorsuch's rule if he adhered strictly to the text of the Constitution. But he does not. He finds "implicit" constitutional doctrines, too. He just insists that his implicit doctrines are legitimate and others' are illegitimate (or "made up"). Not an honest approach.

          Hyatt aside, I think Thomas is the court's most consistent textualist. I admired his opinion in Home Depot v. Jackson, for instance. I was disappointed that Gorsuch joined Alito's "look how great CAFA is, here's some legislative history to prove it" dissent.

          I've always found "Originalists" to be both intellectually dishonest and intellectually lacking. One, Orginalism is just another strategy for interpreting a text, like feminism, structuralism or post-modernism. Two, Originalists begin from a conclusion and work to an argument.

          That is if it's even possible at all to "adhere strictly to the text of the Constitution" considering how vague most of it is. Gorsuch's hypocrisy aside, even "textualists" like Thomas (or Kagan) have to make judgment calls and interpretive leaps all the time.
