ADA compliance would be the Federal issue. The challenge on the state/local levels would be density and safety planning (e.g. road isn't wide enough for fire trucks to traverse). I think Simon's larger point is the default aesthetic poverty we've internalized as citizens.

Non-compliant sidewalks would be the federal issue. Sidewalks basically have to be 4' wide. Concerns about accessibility for fire trucks result in insanely wide streets, although it is clear that there are work-arounds to this problem.
Um the ADA is a federal document. But technically you can build a ridiculously non compliant house as long as it is considered a non multi family. If it is turned into a multi family ( legally) and people rent it? That is when this *gestures* becomes a problem.
