Almost no one knows that. But the Emancipation Proclamation didn't free slaves in the Confederacy because the Union didn't control the states in the Confederacy. It took winning the war first.

Don't waste time looking for the part of the Constitution which empowers a President to make a legally binding Proclamation. Emancipation proclamation was supposed to encourage slaves in the south to rebel. No one was freed. It was a propaganda tactic with no legal authority.
