In 1879 the Illinois legislature accordingly passed a law that stated militia had to have a license. The German-American socialist Lehr und Wehr Verein ("Educational and Defense Society") sued on 2nd Amendment grounds. They were defeated every step of the way.

In 1886 SCOTUS case Presser v. Illinois established "state legislatures may enact statutes to control and regulate all organizations, drilling, and parading of military bodies and associations except those which are authorized by the militia laws of the United States."

It further stated that the Second Amendment to the United States Constitution limited only the power of Congress and the national government to control firearms, not the states.
