Cause he asked consent first. He technically didn't do anything illegal which is why it's labeled as "misconduct"
That is not even close to being right. Asking someone nicely before you commit a crime doesn't absolve the crime.

It does though if they consent because then it's not a crime because they consented. Raping someone is a crime but if you ask "can I have sex with you" and they say yes then it's not a crime.
