Now I'm wondering if anyone tried to sue WoW over the many, many references to real world dances and we just never heard about it.https://twitter.com/Polygon/status/1075115135155474433 …

I feel like it's a bit different since we're not specifically buying references/dances in wow? In fortnite you're specifically buying the floss dance... But Idk

A box price/monthly sub is renting access to the content in the game. I'm not sure it's really all that different? Less direct, certainly, but paying to access something someone claims is their IP seems pretty much the same.

The difference here lies in the fact wow did not charge money solely for the dances or make them rewards or prizes, every race has x dance and you can play x race without paying money solely to play that race and use that dance... Thats big damn difference to fortnite

I don’t know that that’s legally a difference? You’re paying to access the dance either way. It’s not as direct, sure, but you’re paying for access to something either way.

Doubtful. Fortnite is unjustifiably hated, WoW wasn’t. Fortnite is free to play so high adaptability, WoW’s saturation was for hardcore paying people only. The big one: emotes are paid in fortnite, no so in WoW.
