I know it's not how it works but to me they gave up their rights when they've changed management and fired 40% of Carbine, expecting them to somehow recover from it.
Er uh Carbine was shut down entirely. 100%. It is no more. But NCSOFT still of course owns the property.

NCSoft owns the rights, and there's cause or no grounds on which they surrendered them. Bad decisions don't result in forfeiture of property. Does it suck? Yes. Will a private server pop up via VPN or in a non-WIPO/PCT country and thumb their nose at the law? Probably.
