Serious question. Can people run private servers of this game without fear of the company shutting them down?
I don't work for NCSOFT any longer, but I could almost guarantee any attempts to run private servers would be met with C&Ds and formal notices and requests. That's just the reality of IP law.

I know it's not how it works but to me they gave up their rights when they've changed management and fired 40% of Carbine, expecting them to somehow recover from it.

Er uh Carbine was shut down entirely. 100%. It is no more. But NCSOFT still of course owns the property.
