Isn’t that a violation of the CAN-Spam Act?
Oh I'm sure buried deep in google's agreements or settings there's a hidden agreement that by having a gmail account I have to also get this crap.

True, but I thought it was law requiring an opt out from these emails. But like you said, maybe there’s a loophole since you’re using their product. Lame either way.
