Anyone who wants it will start moving towards it or say "excuse me" - in a crowded train I should move and squeeze into other people for a person that does not exist yet?

I’ve encountered this more in DC than in NY... I’ve developed the habit of asking if anyone wants the empty seat and then taking it. Makes no sense to have lots of people standing alongside empty seats.
