Judge Acosta tells both sides to submit briefs, says he’s not sure state can retry or reindict Gable in future. Regardless, Gable is not to be rearrested, judge orders.
‘I’m at a loss, after a full 4 yrs, the state doesn’t know what it’s going to do,’ Acosta says in court.

Update:US Mag.Judge John V Acosta to OR: “If state does not retry Mr. Gable within 10 days of today, you are done with him.” State DOJ says Marion Cty DA won’t retry him in next 10 days but wants to reserve right to rearrest/retry him in future.(1/2)

1. Fagan asked audit staff in Dec. 2021 if they had interviewed Rosa Cazares of La Mota yet.
2. Audits division sent final draft of OLCC audit to the agency on Feb 7. That's eight days before Fagan recused herself from the audit.
