I’ve thought about this question before. Would the US Government have to do a forcible entry and detainer (eviction) of a President from the White House for example since the WH is also a personal residence? I think Dershowitz is a little over-the-top here. 1/

2/ The Constitution and US law provide a remedy. 1. The President has no remedy after 2/3 of Senate have voted to removed him from office. It is a purely political question which I highly doubt the courts have jurisdiction to hear a case on the question.
-
3/ After the Senate votes, the Vice President is sworn into office. The VP is the President and the former President is no longer the President and has no lawful authority to act as the President. (Might be an interesting scenario if the VP refuses to take the oath.)

4/4 US law provides a remedy if a former President (or anyone else w/o lawful authority to be there) refuses to vacate the White House premises. He is trespassing in violation of 18 USC 1753 and can be arrested and removed from the premises + charged.https://www.law.cornell.edu/uscode/text/18/1752 …

It’s a ridiculous attempt to scare people with a constitutional crisis. Congress can impeach for anything (including how POTUS parts his hair). Worrying about the tantrum of the president is not an argument against impeachment, ever.

Pretty sure an impeached and convicted President could be forcibly removed by either the Secret Service or US Marshals.

yes. It's overly dramatic. If he's impeached, he's not the President and the VP becomes president. If he refuses, the secret service would remove him instantly. He would just be an unwelcome citizen... on the bright side, he's always in Florida so they could just take the plane

What a farce. The Constitution doesn't specify what crimes are eligible for impeachment and conviction in the first place, so there would be no basis for a claim of unconstitutionality.

Congress is the supreme branch, so this wouldn't be up to the president. If one looks at the structure of the Constitution as a whole, Congress is the branch with the greatest enumerated powers.

I think the same applies if he loses the 2020 election too.

Our professor
