It’s the kind of thing that makes conservatives paranoid about liberal media bias. (In this case, it could be simply an honest/semantics challenge.)
I assume those writing these headlines have a good grasp of the English language. Have a hard time believing they don't know what they are doing. 8 out 10 people only read the headline. @washingtonpost editors know this.
I think its more likely confusion among reporters and/or news consumers. Also, the tendancy to want to be first in reporting a decision like this often leads to errors. Remember what happened with the Obamacare decision?
