1) UNLAWFUL PRESENCE IN THE U.S. IS NOT A CRIME Unlawful presence is a civil violation of the Immigration & Nationality Act. It is not a crime. **OK--this one needs a footnote An act can be "unlawful" w/o being a crime. See also: -overstaying a parking meter -speeding -late filing taxes -health code violations These are all civil, not criminal, violations. Stop calling them "criminals." It's not up for debate.
"But they still broke the law!" So did I when I was running late for court this morning and took a chance parking somewhere I shouldn't have. Do you really want billions of dollars being spent and kids being traumatized for life for the federal equivalent of a parking ticket?
