GET ICE OUT OF STATE COURTS  🗽

The courthouse arrest debate has so far been largely been between civil rights organizations and the federal government. But these arrests also routinely disrupt years of effort on the part of local police & prosecutors by detaining/deporting defendants, witnesses, & victims.

Keeping federal agents out of state courthouses is not necessarily a radical leftist position. If anything it's a traditionally conservative one which respects basic Constitutional federalism and the appropriate role of state and federal authorities.

DA Rollins says she has no fear of being arrested herself because she has asked people in her office not to obstruct. She added “I’d be honored to be arrested” - says she used to work in the US Attorney’s office and has a deep respect for US Atty Lelling

“We cannot fulfil our statutory obligation to victims of crimes“ when ICE makes courthouse arrests, Rollins said. She said she has seen prosecutions derailed because suspects have been picked up on civil immigration violations.

Rollins said ICE courthouse arrests could violate the victims bill of rights. “ICE isn’t sitting with those victims. We are.”

What do they want? Ryan & Rollins are asking the court for an order vacating ICE’s policy of courthouse arrests. Among the claims is that ICE’s protocol is a violation of the 10th amend, which upholds state’s rights, in that the agency is interfering w local + state institutions.

DA Marian Ryan says lawsuit against ICE to stop courthouse arrests is because ICE violates constitutional rights to access courts - as well as federal and MA common law privilege.
