Depends on the situation. The accident that happened a few days ago, with the Uber Self Driving car, it was kind of the pedestrians fault: no reflectors on clothing or bike while crossing a road at night with almost zero visibility. Not even me, a human, could have avioded her.

The A.I. may have even reacted faster than a human could have.

Its the co that will get sued (eg. @uber), then theyll look for deeper pockets of design teams of software. It could be numerous.

Kind of. But even if she had been awake, there is aost no proof that she could have avoided the pedestrians. It was 1) dark, 2) low visibility and 3) the pedestrian had no reflectors on clothing or bike. I couldn't have avoided her if I was driving a normal car.

Perhaps I was a little to absolute in assigning blame, it should be investigated just like any other accident of the type and if wrong doing is found it would seem the safety driver is at fault unless their was something wrong with car to prevent them from doing their job.
