Once, my father prosecuted a homeless woman who had been found in possession of a 7-inch hunting knife. She appeared in her own defence at trial, and claimed she used the large knife for many daily tasks, like opening tins of food. 1/

During a break, my father popped to the shop, and bought the smallest tin of tuna you can possibly buy. You know, one of those mini ones meant for just one sandwich filling. Aha, he thought, I’ve got her! No way could she open this with that massive knife. 2/

The trial resumed and my father stood up, brandished the tin of tuna and asked the judge to it into evidence, so he could ask the defendant to open it in front of the court. Audible oooohs from staff, a knowing smirk from the judge, my father triumphant... 3/

The tin and the knife was handed to the defendant. To give you some idea, here’s a picture of the type of knife she was in possession of on the streets. It was just like the one used by Crocodile Dundee...4/pic.twitter.com/x7Pd8kq050

The courtroom fell silent as she looked at the tin. Then, in one deft, smooth movement, she took the lid clean off with the knife. To this day, my father has no idea how she did it. Staff are astounded, the judge bemused, my father speechless. 5/

There was no way out, my father knew. Having built the case that she had no good reason to carry the knife in public, she had showed that she could perform essential daily tasks with it. She had, quite literally, cut through his evidence..:.6/

With a nod between my father and the judge, the case was dismissed. Everyone was smiling, and my father spoke to the woman afterwards. ‘I knew you would find the smallest possible tin’, she said, ‘but I actually find those much easier than the big ones.’ 7/n

My father told this story in the context of reading @BarristerSecret’s book. He suspects that woman would be found guilty today, because a prosecutor would not now have the files in time to think through a fair approach. Justice would not be done. 8/ends

That's a good story. My late grandfather's court tales were far more dark and usually ended in the death penalty.
