I didn’t think the constitution was as specific as not being able to charge outside of a declared wartime, but I’ve seen multiple opinions like the one I posted that spelled that out. Good to see it’s more pragmatic than that.

The Framers left a lot of room in various provisions of the Constitution - for very good reasons, most important of which was they did not know what would happen & didn't want to tie the hands of the white, male landowners who would lead the USA.
