Regarding mob rule vs. rule of law, this really applies in other contexts but is important to consider. If you are 1 of 10 people on an island would you want rule of law protecting you or should any 6 or more be able to 'vote' to take your things, enslave you or kill you?
That has to do w/denial of rights versus who is elected. I don't want a minority to cling to power via game playing with the electors.
