I about died. I asked her a bunch of questions about deliberations and what jurors thought of the defense atty because he did something positively bizarre during closing argument.

I will never forget it either. It was so funny that I had to look down and shield my face so the jury could not see me laugh. I wanted to howl.

The funniest thing I saw was a 10 year old boy who was a witness and on cross by the defense atty who had to be kind. Did the police ask about other kids going in there? Yes. Do you know why they asked that? Yes. Why did they ask? They wanted to know. We had to bite our lips.

That kid is literal. Cute.

I had a post-conviction case 1st jury ended in mistrial 2nd convicted We claimed juror misconduct & I deposed former prosecutor 4 the hell of it I asked if he talked w/jurors after 1st jury He sd yes, but only those who voted 2 convict

That’s amateur hour. Talking to the echo chamber doesn’t help your retrial, if you have one. After 10-2 NG, I would hope it wasn’t a retrial. I had an 11-1 hang GAC. About 8 of the jurors came up to me and apologized for not convicting him on all charges. They convicted on one.

It was 10-2 G, but there was a marked difference in the way the pros x-x'd betw 1st & 2nd trials. I still say that is improper contact w/former jurors.

Really? That is wholly allowed here. When the judge releadeas the jurors, he/she says in essence “You’re free to discuss the case now. You may also talk to the attorneys if you would like. However, if either atty harasses you, report it to the court.”
