Okay, this is generally why I don’t talk shop with non-lawyers. What I’m trying to explain is that those legal terms are more complicated than the facts of any one case in particular. So you’re asking me questions as if the answer is a simple yes or no, when that’s not the case.

Sorry - I took a few days away. This is why I always have trial rules (West's Indiana Rules of Court includes EvidR, CrimP, etc) and law dictionaries close at hand. I use WestLaw, too. i.e., you're right. It's not that easy.

Yes, I just wanted someone in CA law to take a look at this case & @JacobAWohl’s past & the number of Twitter troll based on TMZ reporting & ask if this could be a “hit job”

That’s not really a legal question, though. That’s a factual one. I still haven’t seen the facts in this case, but if he was arrested simply because someone other than the victim filed a report, then anyone could surmise that it’s a likely hit job.

But who is the victim?
