BSD sockets are very likely responsible for the FreeBSD license included in the Switch EULA.

The license above the unnumbered list item "Free BSD Kernel" looks very similar the end of the 2-clause BSD license, which means that the unnumbered list item is covered by that 2-clause BSD license.

The bullets are headings, not lists. The FreeBSD section is a massive concatenation of many licenses involved, which includes the gzip license, which just happened to be first.

right, and from what the guys that did the talk at 34C3 found out it is not (although maybe the kernel is BSD derived? But if so, that should show in the EULA, no?)

I think a further confounding effect is that (probably to be legally safe) they seem to have included *all* the license notices from FreeBSD, not just those that applied to whatever code they were using. There are a whopping 93 individual licenses concatenated into that section.
