It's a custom kernel, not BSD derived, but it probably includes BSD code. This isn't uncommon. E.g. long ago I ported the FreeDOS FAT32 driver to PS2 homebrew (for USB storage). My PS2 definitely wasn't running FreeDOS though the license would apply.

There's some evidence to suggest that the first TCP/IP implementation in Windows 95 and forward, until the adoption of the NT kernel, used at least part of the BSD network stack, too.
