right, and from what the guys that did the talk at 34C3 found out it is not (although maybe the kernel is BSD derived? But if so, that should show in the EULA, no?)

It's a custom kernel, not BSD derived, but it probably includes BSD code. This isn't uncommon. E.g. long ago I ported the FreeDOS FAT32 driver to PS2 homebrew (for USB storage). My PS2 definitely wasn't running FreeDOS though the license would apply.
