Well true but forbidding redistribution is against the GPL and that's a big problem considering they use that kernel and even change it therefore they have to agree to the gpl.

Their argument is that they don't forbid redistribution, they just won't renew your contract if you choose to redistribute.

Well while iz certainly isnt as ugly as explicitly forbidding it, effectively it's the same thing as this is quite a threat to anyone who has to rely on those patches for some WAY too important stuff that losing the contract is an even remotely available option.
